Probate & Estates

When someone dies, it is usually necessary to apply to the Court for a Grant of Probate in order to deal with (administer) his or her estate and distribute it to the beneficiaries named in the will.

Applying for a Grant of Probate need not be particularly difficult, although if you are unfamiliar with the forms or tired after being out at work all day, it can seem quite daunting. Please call or e-mail me to discuss how I can help.

Many people instruct solicitors to assist them with the application process, but if you do so it can easily cost £2,000 or more - typically at £200 or more an hour - just to obtain the Grant, even in a fairly simple case. Yet the legal fact is that you don't need a firm of solicitors either to apply for the Grant or to administer the estate, even if those solicitors prepared the will or currently hold it for safekeeping.

I have over 30 years' experience, mainly with central London solicitors, and can assist you with each and every aspect of applying for the Grant of Probate and administering the estate, including completion of the compulsory Inheritance Tax forms and dealing with the estate's Income Tax and Capital Gains Tax – all for around a quarter or less of normal solicitors' fees.

If the deceased person left no will, he or she is said to have died intestate and it is necessary to apply for a Grant of Letters of Administration and distribute the estate in accordance with very specific rules. I have extensive experience of intestate estates, so even if there is no will,

I do not collect or hold any money for the estate, so you, as the Executor or Administrator, will remain fully in control of the estate's money and assets throughout the whole process. Also, there is no minimum fee - you only pay for the time I actually spend assisting you with the estate.

I am happy to do as much or as little as you ask. If all you want me to do is check the forms which you have completed, that's fine. Equally, if you really can't face dealing with all the paperwork and would like me to complete everything for you, I am happy to do so.
